It is informed by the office that during pendency of this writ petition, the suit came to be disposed off on 05.09.2007 by the trial Court. It appears that trial Court has not granted temporary injunction order in favour of the petitioner - plaintiff. Being aggrieved by the same, the petitioner - plaintiff has preferred Misc. Civil Appeal No.12 of 2002 and the III Ad-hoc Additional District Judge, Beed, by judgment & order dated 04.12.2002, dismissed the said appeal. The petitioner - plaintiff has, therefore, preferred this writ petition. There is no interim relief. Consequently, during pendency of this writ petition, the suit came to be disposed off by the trial Court on 05.09.2007.

In view of the same, the writ petition has become infructuous. The writ petition is accordingly disposed off as infructuous. Rule discharged.
