This application is filed for return of the passport for the purpose of getting it renewed which has been surrendered pursuant to a condition subject to which the applicant was granted bail. 3.

The applicant has been implicated for the offences punishable under Section 420, 406 of the Indian Penal Code and Sections 3 and 4 of the Maharashtra Protection of Interest of Distributors (In-financial Establishment) Act, 1999 on an allegation about he having duped the respondent No.2 original informant.

As can be seen from the order granting him bail passed by the Special Judge, pursuant to a statement on behalf of the original informant that the matter was compromised between the parties that the learned Special Judge had granted bail inter alia subject to condition that the applicant surrendered the passport.

The request is now being made that in order to enable the applicant to get the passport renewed for further tenure so as to enable him to travel abroad in future.

Going by the facts and circumstances the request is rather innocuous and can easily be accepted.

The Application is allowed. The passport be returned to the applicant for the purpose of renewal only. He shall surrender the passport within one month from today.
