By the present application under section 439 of the Code of Criminal Procedure, the applicants are seeking their release on bail, in connection with C.R. No.I-249 of 2015, registered with Karjat police station, Ahmednagar, for offences punishable under sections 395, 420 read with section 34 of the Indian Penal Code.

The prosecution story is that the applicants, in connivance with the other accused, have misrepresented the complainant of providing gold at much lesser rate and duped him.

Looking to the nature of allegations in the first information report and

criap640.16 (2) the applicants have already deposited an amount of Rs.1,50,000/- with the Investigating Officer, as also having regard to the fact that there are no criminal antecedents against the applicants and the investigation in the matter is already completed, in my opinion, it will be appropriate to enlarge the applicants on bail. I, therefore, pass following order :- The applicants be released on bail, in connection with C.R. No.I-249 of 2015, registered with Karjat police station, Ahmednagar, for offences punishable under sections 395, 420 read with section 34 of the Indian Penal Code, on each of them furnishing P.R. Bond of Rs.15,000/- with one surety in the like amount.
