The present petition is filed against the dismissal of appeal of the petitioner bearing Appeal No. 8/2014 by the learned Additional Sessions Judge by order dated 07.10.2017. The said appeal was filed challenging the judgment and order passed by the learned J.M.F.C. (5), Parbhani in Criminal Misc. Application No. 447/2012 dated 01.07.2014. Against the said judgment, the wife had also filed appeal bearing PWDVA No. 7/2014 seeking enhancement to the amount of compensation. The compensation amount was enhanced from Rs. 25,000/- to Rs. 50,000/- and monthly maintenance was enhanced from the amount of Rs. 2,500/- to Rs. 5,000/- per month. The petitioners have filed another petition bearing Writ Petition (Stamp) No. 1828/2019 challenging the order passed in Appeal No. 7/2014.

Going by this, this Court finds that, now there is no propriety in entertaining this writ petition. As it is, the amount of maintenance is enhanced to Rs. 5,000/-. There is nothing to show that, the said amount is exorbitant or any illegality is committed by the learned Trial Court or the learned Appellate Court.

The learned advocate Mr. Kalani for the petitioners argued the writ petition, however, this Court does not find any substance in the writ petition. The writ petition, thus, stands dismissed. ( KISHORE C. SANT, J. ) P.S.B.
