Learned counsel for the applicant, on instructions, seeks leave to withdraw the application for condonation of delay to present CrossObjection in the proceeding fled by the Acquiring Body bearing First Appeal No.1268 of 2016, with liberty to avail appropriate remedy under law for fling a regular First Appeal against the impugned Judgment and order passed in LAR No.58 of 2012.

In view of aforesaid submission, leave granted. 3.

The application for condonation of delay stands disposed of as withdrawn with liberty as prayed for.

The proceeding of Cross-Objection bearing Stamp No.3030 of 2020 does not survive and stands disposed of.

The applicant is permitted to get refund of Court fees deposited for fling Cross-Objection and get return the documents produced on record as per rule.
