This application is for recalling order dated 19.12.2023, passed in MCA No. 196 of 2023 to limited extent. Because of the incorrect wording of prayer clause no. 12 A of memo of MCA No. 196 of 2023, mistakes crept into paragraph no. 2 and operative paragraph nos. 7 (ii) of the order dated 19.12.2023.

There is no dispute that proceedings which are sought to be transferred are pending before 5th Civil Judge Senior Division, Pune. Inadvertently, a prayer is made to transfer the proceedings from Family Court, Pune, instead of 5th Joint Civil Judge Senior Division, Pune. The applicant is seeking leave to correct paragraph no. 12 A of memo of the

petition. Considering the nature of rectification, I deem it proper to allow the applicant to correct the prayer clause no. 12 A of the memo of MCA. 3.

For the reasons stated in the application, it is expedient in the interest of justice to rectify the mistakes occurred in paragraph no. 2 and 7 (ii) of the order dated 19.12.2023. At both the places words 'Family Court at Pune' be replaced by words '05th Joint Civil Judge Senior Division, Pune'.

Civil Application is allowed. Necessary corrections be carried out in paragraph no. 2 and 7 (ii) of the order dated 19.12.2023. Corrected copy be uploaded.
