1] The applicant - appellant has moved this application for condonation of delay of 121 days in filing the appeal against the impugned judgment and award passed by the Claims Tribunal.

2] Heard learned counsel for the applicant - appellant and the respondent nos.1 to 5 - claimants. The respondent no.6 is absent, though served.

3] Considering the submissions advanced in the light of overall facts of the case and the reasons assigned to

CA 3776/12 in FAST 3137/12 - 2 - condone the delay, I am of the view that the delay in filing the appeal has been sufficiently explained and the case is made out to condone the delay.
