The petitioner is aggrieved by the order passed by the learned Civil Judge, Senior Division, Shrigonda below Exhibit 41 in H.M.P. No.125 of 2018, thereby striking out the defence of the petitioner for non-payment of arrears of interim maintenance for the period ending 23/03/2022 of Rs.44,000/-. 2.

After filing of the present petition, this court on 17/02/2023, recorded the statement of the petitioner that entire arrears will be paid to the respondent within a period of three weeks from that date.

Learned advocate for the petitioner, on instructions, submits that the petitioner could not pay the arrears of maintenance.

4.

For non payment of arrears of maintenance, the writ petition is dismissed.
