This application is filed for relaxation of condition imposed by Division Bench in Criminal Appeal No. 132/2023. While releasing applicants on bail in connection with C.R. No. 322/2022, registered with Kopargaon Police Station, Dist. Ahmednagar, for offence punishable under sections 302, 354, 294, 326, 324, 323, 504, 506, 509, 143, 144, 147, 148, 149, 427 of Indian Penal Code and under Section 3(1)(r), 3(1)(s), 3(2)(5), 3(2)(v-a), 3(1)(w), 3(1)(g) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, applicants were directed not to enter jurisdiction of village Manjur, TalukaKopargaon, Dist. Ahmednagar, till conclusion of trial. Bhagyawant Punde

Applicants thereafter moved Criminal Application No. 1969/2023 and 1970/2023 for relaxation of said condition. Division Bench by order dated 04.08.2023 rejected said application on merits. This application is moved claiming change in circumstance.

Heard learned advocate for applicants and learned APP for respondent-State. Perused record.

Learned advocate for applicants contends that FIR is lodged on 19.08.2022 and till date trial is not concluded and considering the age of applicants, this application deserves to be allowed.

There is no merit in the contention of applicants that there is change in circumstance. The condition imposed by Division Bench has imposed a specific condition that till conclusion of trial, applicants shall not enter said village. Similar prayer is subsequently rejected by Division Bench. In that view of the matter, there is no merit in the application. Application is therefore rejected.
