Mr.Jadhav, learned counsel submits that Respondent No.4 has carried out unauthorised construction, has erected 2nd and 3rd floor. The Municipal Council is not taking any action though many times the petitioner has represented the Municipal Council. 3.
Mr.Adgaonkar, learned counsel for Respondent No.4 submits that the Respondent No.4 has already moved the Municipal Council for regularisation and also deposited amount of Rs.5,00,000/- (Rupees five lacs).

Mr.Thigle, learned counsel for the Municipal Council
submits that the Municipal Council has already issued notice to the Respondent No.4 U/s 54 of the M.R.T.P. Act for removal of unauthorised construction. The learned counsel further submits that he is instructed to state that within eight(8) weeks, the Municipal Council would take decision and would either proceed U/s 53 of the M.R.T.P.Act and so also take decision on the application of Respondent No.4 for regularisation.

In that case it will be open for the petitioner to put forth its stand before the Municipal Council.

With this observation, the Writ Petition is disposed of. No costs.
