By consent, this Writ Petition can be disposed off by directing the competent authority to make a reference pertaining to the dispute in file No.2018/NH-361/CR-14 in respect of the acquisition of the land in Survey No.72, situated at village Budhoda, Taluka Ausa to the Civil Court and the Civil Court may tag the said reference to the pending suit bearing Special Civil Suit No.610 of 2018, which is pending before the Civil Judge Senior Division, Latur and further the Trial Court before whom the said suit is pending is directed to dispose of

the suit, as expeditiously as possible, in a time bound manner. Hence, I proceed to pass the following order :

ORDER

(I) Writ Petition is hereby disposed off with the following directions :

(a) Respondent No.2 - Competent Authority is hereby directed to make a reference about the dispute in file No.2018/NH-361/CR-14 in respect of acquisition of the land in Survey No.72 to the extent of 2400 square meters to the Principal Civil Court of Latur and upon receiving the reference, the same shall be tagged with the Special Civil Suit No.610 of 2018. (b)The learned Civil Judge Senior Division, Latur is hereby directed to dispose of the Special Civil Suit No.610 of 2018 along with reference, as expeditiously as possible, preferably within a period of three (3) months from the date of this order.

(c)Parties shall co-operate the Trial Court to dispose off the suit in expeditious manner as directed by this Court.
