We have heard Mr. Deshpande, learned counsel for the petitioner.

The learned Assistant Government Pleader for respondent Nos. 1 to 3 submits that the petitioner has remedy of statutory appeal.

In the light of that, writ petition is disposed of with liberty to file an appeal. In that event all contentions are kept open. If petitioner files an appeal, same shall be decided on its own merits, in accordance with law, expeditiously and preferably within a period of one (01) month from the date of receipt of appeal.
