This miscellaneous civil application has been moved by wife, seeking transfer of proceedings bearing Hindu Marriage Petition no. 107 of 2015 for dissolution of marriage filed by respondent-husband in the court of Civil Judge, Senior Division, Osmanabad, to the family court at Aurangabad.

It is contended that it is difficult for the applicant to attend the proceedings at Osmanabad and that a son about four years is to be
M.C.A.No.52/2016 maintained by her who is attending nursery school at Aurangabad. It is further being informed that respondent is attending the maintenance proceedings at Aurangabad.

The matter had been adjourned earlier on 16.11.2016 at the request of respondent. While the matter is being called out today, once again there is no appearance for respondent today which, to a large extent, indicates that respondent does not have any particular resistance to the request made under the miscellaneous civil application.

In the circumstances, miscellaneous civil application stands allowed in terms of prayer clause (B) and is disposed of. Rule made absolute accordingly.
