Mr. Jadhav, the learned counsel for the petitioner submits that, the petitioner had applied from N.T.-B category (Marathi Medium). The learned counsel submits that, persons having less marks than the petitioner are appointed from N.T.-B category. According to the learned counsel even names are given of those candidates who are possessing less marks than the petitioner and are appointed. The said details are given in para 4 of the writ petition.

Mr. Nikam, the learned counsel for the respondent No. 2 submits that, the petitioner is considered from N.T.-B category.

2 wp 1396.15 No candidates having less marks than the petitioner are appointed from N.T.-B category of Marathi Medium of the revised merit list.

We have considered the submissions. The petitioner is considered from N.T.-B category Marathi Medium (80%). A statement is made by Mr. Nikam, the learned counsel for the respondent No. 2 that, the candidates who are named in para 4 of the petition are considered from English Medium (20%) category and no candidate having less marks than the petitioner is appointed from N.T.-B category Marathi medium (80%) category. The said statement is accepted.

In view of the said statement, the case of the petitioner cannot be considered. The petitioner would have grievance, only if, any candidate having less marks than the petitioner is being appointed from the category of the petitioner. The writ petition is disposed of. No costs.
