Initially the petition was filed by four petitioners. Petitioner No.4 withdrew from the petition. It appears that, he has suppressed certain facts. This Court has, therefore, saddled him with a cost of Rs.50,000/-. Learned Advocate for the petitioners informs that, the cost amount has been deposited.

The petitioners claim to have belonged to 'Naikda' Scheduled Tribe. Their tribe certificates were subjected to scrutiny. The Respondent/Scrutiny Committee did not grant validity certificates. The petitioners are, therefore, before us. The petitioners mainly rely on number of validity certificates issued in favour of their blood relations. Some of the validity certificates have been issued pursuant to the directions given by this Court in more than one writ petitions. The learned Advocate Mr. Jadhav for the petitioners, therefore, urged

2 936.WP-1514-2025.doc for grant of validity certificates on such terms and conditions. 3.

Learned A.G.P would on the other hand, submit that, there were some overwritings and erasers as well. As such, the petitioners tried to manipulate the record so as to make out a suitable case. So far as the question of this Court's granting validity certificates to the blood relations of the petitioners are concerned, the learned A.G.P has no answer to offer.

We have considered the submissions advanced by the parties. We do not propose to go into the factual matrix. Suffice it to say that, there are eight validity holders who are the blood relations of the petitioners. Six of them have been issued validity certificates pursuant to the directions passed by this Court in more than one writ petitions. We have, therefore, no option but to grant the petitioners, validity certificates.

In the result, the petition succeeds in terms of the following order :

ORDER

a) The Writ Petition is allowed.

b) The order dated 17.01.2025 passed by the Respondent No.2/Scrutiny Committee is quashed and set-aside. c) The Respondent/Scrutiny committee is directed to issue to the petitioners the validity certificates of 'Naikda'

d) The validity certificates to be issued to the petitioners shall be coterminous with the six validity certificates issued by the High Court and relied upon by the petitioners before us.
