The applicants/original claimants have filed the present application for withdrawal of the amount deposited by the respondent No.1/original appellant. The learned counsel appearing for the respondent No.1 /original appellant strongly resisted the application and in the alternative, submits that the applicants/original claimants may be permitted to withdraw the amount by imposing certain conditions.

For the reasons stated in the application that death claim is decided as back as in the year 2008, the applicants/original claimants are entitled to withdraw the amount deposited by respondent No.1/original appellant on certain conditions. Hence following order: 1/2

i. The applicants/ original claimants are hereby allowed to withdraw of Rs.4,23,000/- with accrued interest thereon on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court.
