The Petitioners had preferred an application seeking dismissal of the Petition No.4/2012 filed by the Respondent No.1 under Section 41D of the Maharashtra Public Trusts Act, 1950 on preliminary grounds. By the impugned order dated 07.11.2014, the learned Joint Charity Commissioner, Nashik has rejected the said application. It is informed that the Petitioners are yet to file a written statement in response to the Petition filed under Section 41D by the Respondent No.1.

*2* wp.2278.15.914 The learned Advocate appearing for the Petitioners, on instructions, submits that the Petitioners desire to withdraw this Writ Petition so as to file a proper written statement and raise all objections along with the written statement.

The learned AGP appearing for the Respondent No.2 has no objection.

In the light of the above, this Writ Petition is allowed to be withdrawn and is, accordingly, disposed of.

The Petitioners naturally have to file the written statement in response to the Petition filed under Section 41D by the Respondent No.1. As such, the Petitioners are at liberty to file a detailed written statement and raise all contentions and averments as they may deem fit and proper. (RAVINDRA V. GHUGE, J.)
