The Sub Divisional Officer, Ahmednagar, Division Ahmednagar, in response to the petition, has filed an affidavit contesting the claim in the petition and in paragraph No.11, he has made the following statement :- "11. With reference to para no.11 of the writ petition, I say and submit that, the contentions of the petitioner that the order of the Sub Divisional Officer, Nagar Division, Ahmednagar has not been implemented is not true and correct. I say and submit that, in this regard, the Tahsildar, Newasa vide its letter No.Rasta Case/64/2015, dated 29.04.2015 has reported to he Sub Divisional Officer, Ahmednagar that, as per the order of the khs/Jan.2022/2267

- 2 - Sub Divisional Officer, the notices were served upon the petitioner and present Respondent No.3 on 30.01.2015 through Circle Officer, Sonai, Tal.Newasa, Dist.Ahmednagar, for implementation of the order passed by the Sub Divisional Officer. Here to annexed and marked as EXHIBIT-2 is the copy of report of Tahsildar, Newasa, dated 29.04.2015." 2.

Infurtherance of the said statement, the documents accompanying the affidavit are perused and it reflect that on 04/02/2015, the statement of the petitioner is recorded where he has undertaken that he will not create any obstruction. 2.

In the wake of the aforesaid statement, the petition has been rendered infructuous and is disposed off as such. ( BHARATI H. DANGRE, J.) khs/Jan.2022/2267
