1] Heard learned counsel for the applicant, the learned APP for the respondent-State and the learned counsel for the informant.
2] Criminal Application No.369 of 2025 is partly allowed to the extent of intervention in the matter. 3] The applicants have approached this Court apprehending arrest in connection with Crime No.353/2024, dated 22.11.2024, registered with Basamba Police Station, District Hingoli, for the offences punishable under Sections 117(2), 117(3), 115(2), 352 & 3(5) of the Bhartiya Nyay Sanhita, 2023.
4] The allegations against the present applicant is that the applicant has assaulted the informant with the use of rod and grievous injury is caused to the informant. 5] The learned counsel for the applicant submits the custodial interrogation of the applicant would not be necessary and that the applicant would cooperate with the investigation and seeks anticipatory bail.
6] The learned counsel for the informant submits that the informant has no objection if the anticipatory bail is granted and that they would move appropriate proceedings for quashing.
7] Considering the rival submissions, in the meanwhile, there shall be interim order in the following terms :-
A] Till the next date, in the event the applicant is arrested in connection with Crime No.353/2024, dated 22.11.2024, registered with Basamba Police Station, District Hingoli, for the offences punishable under Sections 117(2), 117(3), 115(2), 352 & 3(5) of the Bhartiya Nyay Sanhita, 2023, he shall be released on bail on furnishing PR bond of Rs.15,000/- with one or two sureties in the like amount.
B] The applicant shall remain present before the investigating officer on 11.02.2025 and 12.02.2025 between 10:30 a.m. to 01:30 p.m.
C] The applicant shall co-operate with the investigation, including producing all documents in his possession, as may be demanded by the investigating officer.
D] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.
8] Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled. 9] List on 17.02.2025.
