Heard. The Counsel appearing for the petitioner vehemently opposed the prayer in the intervention application and submits that, applicant is noway concerned with the relief claimed by the petitioner, since the petitioner was appointed on compassionate ground and, therefore, there is no question of considering seniority while appointing petitioner on Class III post, as contended by the applicant. 2.

We have considered the submission of the Counsel appearing for the applicant and learned Counsel appearing for the non applicant / respondent. In our opinion, since the applicant claims that he is at Sr.No.9 as per the seniority list, and entitled for promotion / appointment on Class III post, the applicant deserves to be heard in the present writ petition.
