Learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. However, learned J.M.F.C. is requested to make endeavour to conclude the proceedings in STC No.3190 of 2006 as expeditiously as possible, preferably within a period of six months.

Learned Counsel appearing for respondent No.2 submits that respondent No.2 is an accused in the cross case and that the learned Magistrate may hear both the cases simultaneously. In the eventuality that the

( 2 ) cria588.15 respondent No.2 files an application for the same, learned Magistrate upon verification of the records shall consider the application on its own merits. Learned Magistrate shall not be influenced by the withdrawal of the present application.
