This matter was heard on the last occasion and posted today for "passing orders" as we were of the view that the parties would be able to resolve the dispute. 2.

Shri Deshmukh, the learned advocate representing the respondent/ Management, places on record the communication dated 20.10.2021 received by the Management from the Education Officer (Secondary), Zilla Parishad, Aurangabad, wherein, the Education Officer has advised that as the concerned post would be falling vacant in January, 2022 due to retirement of an incumbent employee, the petitioner could be

*2* 905wp1829o20 accommodated in his place post such retirement. We have taken the said communication dated 20.10.2021 on record, which is marked as "X" for identification.

The learned advocate for the petitioner submits, on instructions from the petitioner present in the Court, that he is ready and willing to occupy the said post from January, 2022 pursuant to the retirement of the incumbent teacher. He, therefore, submits that the petition is worked out. 4.

Considering the consensus amongst the parties and in the light of the communication "X", this Writ Petition is disposed off.
