The Petitioner herein claims to be a daughter of a project affected person, whose land was acquired for development of the Respondent - University. There is no dispute as to the acquisition of the land. The P.A.P. certificate has been issued by the District Rehabilitation OfÏcer, Collector's OfÏcer, Parbhani [hereinafter referred to as 'D.R.O.'] in the name of three persons, namely, Jija Munjaji, Babu Dhondiba and Manik Munjaji, on 08/02/1984. 2.

The learned Advocate for the Respondent - University submits that on the strength of P.A.P. certificate issued, the Respondent - University has given a job to Jija Munjaji. According to him, all these three persons appeared to be from one and the same family, and therefore, when only one of the family members of P.A.Ps is entitled for a job and same has been granted to Jija, the Petitioner would not be entitled for a job on the strength of P.A.P. certificate issued in the name of her father. The learned Advocate ultimately

urged that, the matter may be remitted back to the D.R.O. to find whether Jija Munjaji, Babu Dhondiba and Manik Munjaji are from different families and if they are so, separate P.A.P. certificates could be issued in their names.

The learned Advocate for the Petitioner would submit that Jija Munjaji and Babu Dhondiba are from different family and even of caste as well.

We hope that the concerned OfÏcer would consider the same and decide the matter, within a period of three months from the date of receipt of a copy of this order.

The writ petition thus stands disposed of in terms of the following order :

ORDER

[I] The matter is remitted back to the District Rehabilitation OfÏcer, Parbhani, to decide whether these three persons, namely, Jija Munjaji, Babu Dhondiba and Manik Munjaji are from one and the same family or distinct, and then issue P.A.P certificates separately in their names.

[II] If a separate P.A.P. certificate is issued in the name of father of the Petitioner, the Respondent - University would do the needful to give her employment with it, if she otherwise deserves. [III] The District Rehabilitation OfÏcer, Parbhani shall give an appropriate opportunity to the Petitioner to place before him material in support of her claim.
