Learned counsel for the appellants seeks leave to correct the parties in the title clause. It is submitted that respondent No.1 Bhanudas Eknath Sawant died and he is survived by four legal heirs. Out of them, three are brought on record but inadvertently Shamrao Bhanudas Sawant remained to be brought on record. Appellant is permitted to carry out the correction and the amendment forthwith.

In pursuance of the orders passed in first session, learned Registrar (Judicial) has submitted a report disclosing the identification of the parties and the verification.

I have gone through the report. The parties and their respective learned counsels are present. I have independently ascertained the identification of the persons present with the assistance of learned counsels. I find no impediment in permitting the parties to settle the second appeal in terms of the consent terms.

In view of settlement terms, second appeal is disposed of.

5.

Decree be drawn up accordingly of which the settlement terms shall be made part and parcel.

No order as to costs.
