The learned Advocates for the respective sides submit that the litigating parties have settled the dispute between themselves. The settlement terms have been reduced into writing and are being placed on record.

The settlement terms (12 pages) are taken on record and marked as Exhibit 'X" for identification.

By the civil application, the applicants pray for condonation of delay in filing the civil application for bringing the LR's of deceased respondent No.1 on record. It is stated that as the petition was admitted and interim relief was refused, the litigating sides were khs/JUNE 2017/2086

awaiting a final hearing. After the parties decided to settle the matter, they realized that unless the LR's of deceased respondent No.1 are brought on record, the settlement would not be completed, hence the delay.

The non applicants do not oppose as they have settled the matter.

This civil application is allowed. The LR's of deceased respondent No.1 shall be brought on record forthwith. 6.

It is at the request of the parties that the original copy of the settlement terms has been taken on record and marked 'X'. 7.

Considering the above, the writ petition, by the consent of the parties, stands disposed of in terms of the settlement Exhibit 'X' which shall be a part of this order.
