Learned counsel for the petitioner, on instructions, submits that the petitioner wishes to withdraw the present writ petition. However, liberty to file appropriate proceeding may be granted and it may also be observed that the Civil Court while dealing with such proceeding shall not be influenced by the observations made in the present impugned order. .

All the submissions are reasonable one.

Accordingly, the criminal writ petition is allowed to be withdrawn with liberty as prayed for. Further, the learned Judicial Magistrate First Class shall not be influenced by the observations made in the present impugned order.
