Mr. Tripathi the learned for the petitioner submits that the draws were drawn for reserving the post of Sarpanch on 18.11.2020 and at that time, the post of Sarpanch for Grampanchayat Bhangapur was reserved for General (women) category. The petitioner No.1 is elected as a Member of Grampanchayat Bhangapur from General (women) category. There was no reason to cancel the said reservation. The said action is arbitrary and now, the reservation is kept for OBC (women) category. The same is illegal. The reservation could not have been repeated for Women category this time.

The post of Sarpanch of Grampanchayat Bhangapur was reserved for General category in the year 2010, in the year 2015, it was reserved for General (women) category and now, it is reserved for OBC (women) category. The same could not have been reserved for General or General (women) category at this time. 3.
