Learned counsel for the petitioner states that limited relief is claimed in the petition seeking direction against respondent no.2 to decide the appeal and the stay petition filed before it, expeditiously.

Learned A.G.P. states that in case same is pending the Commissioner would take decision upon it on its own merits, however, further states that the petitioner, from its pleadings, appears to have filed Revision before the Hon'ble Minister. 5.

In view of the fact that the appeal is pending before the Hon'ble Minister, the Commissioner shall take decision on the stay petition filed by the petitioner after hearing all the parties in the appeal, expeditiously, preferably by 25.3.2017.

Mr. Amol Joshi, advocate holding for Smt.

Anjali Dubey, learned counsel waives notice for added respondent. The petitioner and the added respondent shall appear before the Commissioner in the pending appeal on 21.2.2017.

All the contentions of respective parties are kept open.

Writ Petition disposed of. No costs.
