All these applications are filed for getting the delay of 1777 days condoned for filing first appeal. The Government intends to challenge the Judgment and award passed by learned Joint Civil Judge, Senior Division, Nilanga Dist. Latur dated 20-12-2012. 2.

It is contended that, after the award is passed, the AGP who was representing the State before the Reference Court had intimated the same to the Government with a legal opinion which was then placed before the Law and Judiciary Department and then the recommendation was obtained. Thereafter again a scrutiny was done and the proposal was then given to the Government Pleaders Office attached to this Court. It took some time for drafting the memo and

CA 5042-2018 getting the copies of the relevant documents. It is contended that, the delay is unintentional and it was caused because of administrative difficulty which was beyond the control of the Government.

The respondents in respective applications have been served with notice. Only in Civil Application No.5040 of 2018 it appears that the respondent therein appeared through advocate. In other matters it appears that, the Vakilpatra is not filed. Today neither the respondent himself nor the concerned advocate who is representing the respondent in one of the matter is absent. That means, whatever has been stated in the applications has not been countered.

Under such circumstance, taking lenient view, the delay in all the applications is hereby condoned. Registry to verify and register the first appeals and it may be placed before this Court on 09-072019. All the above applications are disposed of accordingly. (SMT. VIBHA KANKANWADI) JUDGE vjg/-
