PER COURT :- 1) Heard. There is a consistent evidence in the form of three dying declarations of the deceased which point towards guilt of the accused. Apart from this, there is oral evidence of the daughter, who has witnessed the alleged incident and has cited the accused as a culprit and author of the burn injuries sustained by her mother. 2) The accused was not enlarged on bail during the course of trial. Prima facie, we find that the accused/applicant is not entitled to be released on bail during pendency and disposal of the appeal. The Criminal Application is devoid of substance and stands rejected.
