IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD PUBLIC INTEREST LITIGATION NO. 18 OF 2017 Anirudha @ Sudhir s/o Rameshrao Salunke Petitioner
Versus
The State of Maharashtra & others Respondents Mr. S.V. Gundre, advocate for the petitioner. Mr. P.S. Patil, A.G.P. for Respondent no. 1.
CORAM : R.M.BORDE & K.L. WADANE, JJ.
DATE : 13th APRIL, 2017 PER COURT:
Petitioner is objecting to the decision taken by the Government on 13.10.2016 in respect of conversion of respondent no. 4 Government Women Polytechnic college into co-education polytechnic college.
It is specified in the Government Resolution that the State Government has taken a decision to upgrade certain polytechnic colleges in the State including the college established at Latur. It is also recorded in the Government Resolution that conversion of Government Women Polytechnic College into Co-education College would be subject to approval from AICTE. Learned counsel for
{2} pil18.17.odt petitioner pointed out that the AICTE has refused to accord permission for conversion of Government Women Polytechnic College however, it is pointed out on behalf of the State that the decision taken by AICTE is subject to appeal and, if at all, the appellate forum or the AICTE permits conversion of college further steps in pursuance to the decision of the State Government would be taken. It is clarified that the decision of the State Government in respect of conversion of women polytechnic college in coeducation polytechnic college would be subject to the decision of the AICTE or the appellate authority and, until such approval is accorded, conversion shall not be enforced.
So far as petitioner herein is concerned, he is not connected with the Government Polytechnic nor his ward is taking education in any of the colleges at Latur. Petitioner infact does not have any concern with the dispute raised in the petition. It is contended that intake capacity of the polytechnic college would be reduced. The argument raised in the petition is devoid of any substance. There is absolutely no basis for making resistance for upgradation of polytechnic college.
