The petitioner is the former Sarpanch of Village Panchayat Takli Kadim of Taluka Gangapur, Dist. Aurangabad. By order dated 02-12-2014, the Divisional Commissioner Aurangabad has disqualified the petitioner for the post of Sarpanch in connection with the failure to maintain proper records pertaining to the 'Chara Chawani' and other connected aspects.

The petitioner submits that an appeal has been preferred under Section 39 of the Maharashtra Village Panchayat Act along with a stay petition before the Hon'ble Minister for Rural Development, on 31-12-2014. The appeal as well as the stay petition is pending. The petitioner therefore prays for protection

2269.2015 WP and alternatively prays that the Hon'ble minister be requested to decide the appeal and the stay petition expeditiously 3.

The learned AGP on behalf of respondent Nos. 1 , 2 and 3 submits that the petitioner can appear before the Minister and the main appeal itself could be decided within a period of three months from the 1st date of appearance. The petitioner is agreeable to the said suggestion.

In the light of the above, this petition is disposed off. Learned AGP shall communicate to the Hon'ble Minster that the notices be issued in the appeal preferred by the petitioner within a period of two weeks from today. The date of hearing in the matter be indicated as 06-04-2015 at 3.00 pm in the office of the Hon'ble Minister.

From the date of appearance of the parties to the appeal on 06-04-2015, the Hon'ble Minister shall decide the said appeal on or before the 4th day of July, 2015. The litigating sides shall abide by the dates of hearing as may be posted by the Hon'ble Minister and shall refrain from seeking adjournments on unreasonable grounds.
