The petitioner is an employee of respondent No.4, which is a private educational institution affiliated to the University at Aurangabad. He has already moved a detailed representation to respondent No.3 dated (Nil) July, 2022, which is placed at page 32 in the petition paper book. The same was preceded by another representation to respondent No.3 (dated (Nil)/(Nil)/2014) at page 36. In these representations, he has prayed for the benefits of the sixth and seventh pay commission recommendations.

In view of the above and since respondent No.4 is not the "State" under Article 12 of the Constitution of India, this Writ Petition is disposed off with the direction to respondent No.3 to consider the above mentioned two representations of the petitioner by following the due procedure laid down in law. A reasonable opportunity of hearing shall be granted to all the stakeholders. A decision on the said representations, shall be arrived at, on or before 31.05.2023.
