The applicant is seeking regular bail in Crime No. I-403 of 2014 registered on 29/12/2014 pursuant to the complaint lodged by Police Inspector, Tophkhana police station, Ahmednagar, for the offence punishable under Sections 420, 465, 468, 470, 471 read with Section 34 of Indian Penal Code.

The allegation against present applicant is that the applicant has abetted crime in the matter of preparation of forged document certifying false date of birth of accused Raosaheb Tagad

-2so as to secure the benefit of provisions of Juvenile Justice Act. 3.

While trying to make out the case for grant of bail, learned Counsel for the applicant would urge that there are no criminal antecedents against the applicant, investigation in the matter is complete and charge sheet is filed. Nothing is recovered from the present applicant. Upon the statement of another accused, the present applicant is impleaded in the crime in question. 4.

Learned A.P.P. submits that the investigation in the matter is complete and charge sheet is already filed. According to him, Court may pass appropriate order in the matter. 5.

The fact remains that there are no criminal antecedents against the applicant and is seeking regular bail in the offence punishable under Sections 420, 465, 467, 468, 470, 471 read with Section 34 of Indian Penal Code. He was arrested on 27/07/2015 and during P.C.R. nothing came to be recovered from him. There are no criminal antecedents against the present applicant, further detention, as such, is not necessary.

In view thereof, it will be appropriate, in my opinion, to order the release of the applicant on bail. Hence, the following

-3order:- The applicant be released on bail, in connection with Crime No. I-403 of 2014 registered with Topkhnana Police Station, Ahmednagar for the offence punishable under Sections 420, 465, 468, 470, 471 read with Section 34 of Indian Penal Code, upon executing P.R. bond of Rs.15,000/- with one surety in the like amount. The applicant undertakes to attend trial regularly. 7.

The application is allowed in above terms.
