Heard learned counsel for respective parties. 2.

The petitioner challenges the suspension order dated 05.06.2017 passed by Sub Divisional Officer, Degloor and order dated 20.06.2021 passed by the Additional Divisional Commissioner, Aurangabad, whereby appeal filed by the petitioner came to be dismissed by the Additional Divisional Commissioner and order of S.D.O., Degloor is confirmed. The petitioner was suspended from the post of Police Patil on the ground that a criminal case was registered against her.

Now, the learned counsel for the petitioner submits that the criminal case is still pending. Since the petitioner was suspended from the post of Police Patil on account of the said criminal case, I find no reason to interfere with the suspension order dated 20.06.2021 passed by the Additional Divisional Commissioner, Aurangabad under Article 227 of the Constitution of India.

However, if the petitioner is acquitted in the criminal case, he may file proper application before the competent authority and such application shall be considered on its own merits. 5.

In view thereof, writ petition is dismissed. No order as to costs.
