The learned AGP placed on record the communication dated 12th January, 2023 issued by the learned Collector, Aurangabad- Mr. Astik Kumar Pandey who is present before the Court today. It is mentioned in the said communication that the compensation awarded in the present case was more than 4 times and therefore, as per the advice of State Govt. the present appeal has been fled. However, it seems that while giving such advice, the fact that the matter was settled in the Lok Adalat was ignored.

Now, the learned AGP on instructions, seeks to withdraw the appeal on behalf of the State. The learned counsel for the respondent claimant has also no objection, if the appeal is withdrawn. In view of the same, the appeal stands withdrawn and disposed of.

Pending Civil Application is disposed of.
