The learned Advocate Shri. Aditya V. Kasane h/f. the learned Advocate Shri. V.D. Salunke for the Petitioners submits that, the Petition can be disposed off with a direction to the learned Trial Court to dispose of the civil suit within a stipulated time.

The learned Advocate for the sole Respondent submits that, since there was no stay operating in this Petition, the civil suit has proceed and the evidence is going on.

The Petitioners are the Orig. Defendants in Regular Civil Suit No.292/2020 before the learned Civil Judge Jr. Division, Tuljapur. The learned Trial Court allowed the Application below Exh.5 for injunction preferred by the sole Respondent, who was the Orig. Plaintiff. Against the grant of temporary injunction, the Petitioners moved before the District Judge-1, Osmanabad in Misc. Civil Appeal No.35/2021 which also came to be dismissed. Thereafter, the Petitioners approached this Court in this Writ Petition under Article 227 of the Constitution of India.

Admittedly, there is no interim order in this Petition. Consequently, the suit has proceed and the evidence is going on. Thus, the learned Advocate for the Petitioners submits that, the Petition be disposed off as not pressed.

The Writ Petition stands disposed off as not pressed. 5.
