This civil application is allowed on the following conditions:- (A) Delay of 113 days caused in filing the civil application is condoned subject to costs of Rs.1,000/-.

(B) By consent of the respondents, the costs amount is donated for the treatment of poor patients and shall be deposited with the Government Medical College and Hospital, Aurangabad, through Medical Officer, High Court Dispensary, Aurangabad, either in cash or by Demand Draft (Demand Draft be drawn in the name of "Dean, Government Medical College and Hospital Dengi Samiti, Aurangabad") on/or before 10.9.2018, failing which this order shall stand recalled and the order dated 11.9.2017, dismissing the petition shall be restored without reference to the Court on 11.9.2018.
