Learned Counsel appearing on behalf of the petitioners, on instructions, makes a motion for withdrawal of the petition with liberty to move appropriate application under the provisions of Section 36-B of the Bombay Prevention of Fragmentation and Consolidation of Holdings Act, for referring the issue raised in the suit to the competent authority. Petition stands disposed of as withdrawn with liberty as prayed for. 2.

If application as aforesaid is moved by the petitioners, the Civil Court is expected to deal with the same in accordance with law, without being influenced by the observations made in the order impugned in the present petition.
