Heard learned counsel for the petitioner.

Learned counsel for the petitioner submits that this petition can be disposed of by directing the trial court to expedite the hearing on the original application filed under Section 125 of the Code of Criminal Procedure.

Learned counsel for the respondent has no objection for early hearing. But, this matter can be decided on merits. 4.

The respondent has filed an application for maintenance under Section 125 of the Code of Criminal Procedure wherein the Family Court granted interim maintenance which is challenged in this writ petition. The original application was filed in the year 2019.

(2) criwp162.20 It is expected from the trial court to dispose of the original application within six months. Therefore, main application is required to be decided that would be convenient to both the parties. Hence, I pass the following order.

ORDER

i.

The writ petition is disposed of.

ii.

The Family Court, Jalna is directed to decide the application of respondent No.1 bearing No. E-144 of 2019 as early as possible, preferably within a period of four months from today.
