Heard advocate Pawar learned counsel appearing for the applicant and Mr. A.S. Shinde learned AGP appearing for non-applicant nos.1 and 2.

The applicant prayed for condonation of delay of 1381 days caused for lodging the appeal on the ground that due to his unsound financial capacity he could not approach this Court within the stipulated period and the applicant is having good case on merit. The non-applicant nos.1 and 2 have not seriously objected for condonation of delay. Therefore, considering the nature of claim, it would be just and proper to condone the delay of 1381 days caused while lodging the appeal, however, the applicant shall not claim
( 2 ) 929 ca 13270.17 interest for the delayed period. Accordingly, I proceed to pass the following order:
ORDER
I) The application for condonation of delay is hereby allowed. II) The delay of 1381 days is hereby condoned. The applicant shall not be entitled for the interest for the delayed period. III) The Registry is directed to register the first appeals and place it before the Court for further action.
