Mr. Bhadekar the learned counsel appearing for the appellant on instructions submits that on 07.04.2015 the appellant Bala Kisan Karded died during the pendency of appeal. So also, the legal heirs of deceased appellant obtained heirship certificate under the Bombay Regulation Act on 18.02.2021, however the legal heirs of the appellant failed to approach him and no legal heirs of deceased appellant were brought on record till date. 2.

Therefore, the appeal is abated under order 22 Rule 6 of the CPC. [Y.G. KHOBRAGADE, J.] mub
