Mr.Dhage, learned counsel relies on the order passed by the Division Bench of this Court dated 26.7.2016 in Writ Petition No.3721/2016 and submits that the petitioner is similarly situated.

In this case the father of the petitioner though had died earlier was brought on CRT in the year 2007 and the petitioner had

In Writ Petition No.3721/2016 also the father of the petitioner therein was brought on CRT in the year 2007 though had died earlier.

It is stated that the order of this Court in Writ Petition No.3721/2016 dated 26.7.2016 has not been challenged by any party and the same has become final. The said order is also implemented inasmuch as the delay on part of the petitioner therein is condoned by the Respondents therein. The Respondents in Writ Petition No.3721/2016 and in the present Writ Petition are same.

In light of the above, we follow the same course.

For the reasons stated in the order dated 26.7.2016 in Writ Petition No.3721/2016, we direct the Respondents to consider the application of the petitioner for compassionate appointment on its own merits without considering the aspect of delay.

The Writ Petition is accordingly disposed of. No costs.
