The mistake in recording date of birth of the petitioner appears to be obvious mistake and obvious mistake can be corrected even after the student has left the school. Same has been accepted by the Full Bench of this Court in a case of Janabai Thakur Vs. State of Maharashtra reported in 2019(6) Mh. L. J. 769.

It is submitted that the Education Officer Primary has already directed correction of the record of the primary school and same has been corrected. It is the record of secondary school that is not corrected. The date of birth of the petitioner is recorded as 29.02.1989. The petitioner claims to be born on 28.02.1989. The year 1989 was not a leap year as contended by

2 wp 1977.20 the petitioner. As such date 29.02.1989 recorded is obvious mistake.

In the light of the above, the respondent Nos. 2 and 3 shall allow the proposal of the petitioner for correction of date of birth as 28.02.1989. Same be done expeditiously and preferably within a period of three (03) months from today. The writ petition is disposed of. No costs.
