The learned A.G.P. has raised a preliminary objection that the alternate efficacious remedy is available to the petitioner to file the revision under section 9 of the Maharashtra Money Lending (Regulation) Act, 2014 (for short referred as 'the Act'). Learned AGP submits that in a case Vishwanath Marotrao Ganjre Vs. Divisional Joint Registrar and others in Writ Petition no.5362 of 2017 this Court (Coram : Rohit B. Deo, J.) by order dated 28.08.2018 has taken the similar view.

Learned counsel appearing for the parties have also not disputed this settled legal position.

In view of the above submissions, the learned counsel appearing for the petitioner seeks leave to withdraw this petition, with liberty to the petitioner to avail the alternate efficacious remedy of

Leave granted.

Writ petition is disposed off as withdrawn with the liberty to the petitioner to avail the alternate efficacious remedy, so available in law. Upon filing such revision, the revisional authority may consider the time spent in pursuing this writ petition before this Court for condoning the delay caused in filing the revision, if any. ( V. K.
