Heard both the parties.

The parties to the proceedings have arrived at amicable settlement.

The learned trial Court by its judgment and order dated 09.04.2012 held the Applicant guilty of offence punishable under Section 138 of the Negotiable Instruments Act. The Applicant was directed to pay an amount of Rs.30,000/- to the Complainant as

compensation. The same order was challenged by the Applicant by filing Criminal Appeal No.107/2012 in the learned Sessions Court, at Aurangabad. The learned Sessions Court by judgment and order dated 21.08.2019 was pleased to modify the sentence of Applicant, she was sentenced to suffer Simple Imprisonment till rising of the Court and the amount of compensation was increased to Rs.50,000/-. Both the parties agreed that on the passing of the judgment, immediately the Accused/Applicant deposited the amount of Rs.50,000/- in the Sessions Court at Aurangabad, which is withdrawn by the Respondent No.2Complainant. 3.

This Revision Application is filed challenging the judgment that passed in Criminal Appeal No.107/2012, now there is a settlement and the Applicant has paid Rs.5000/- in cash to Respondent No.2. The Respondent No.2 accepts that he has received the amount of Rs.5000/- in cash.

In view of this, both the parties have filed affidavit and verified the contents of the Pursis. Parties are also present in the Court. They accept the compromise between them.

With this, the Revision Application is disposed of by compounding the offence under Section 138 of the Negotiable Instruments Act. [ KISHORE C. SANT, J.] Najeeb.
