Mr. Kshirsagar, the learned counsel for the petitioner states that, the petitioner college was given H.S.C. Centre since many years. This year it has been abruptly cancelled. The procedure has not been followed. No show cause notice was issued. There are 149 students in the petitioner college, who are to appear for 12th standard examinations. Because of the centre being attached at Parbhani, the students will have to cross railway gate. The same is hazardous. The distance is almost 10 K.M. The procedure is also not followed in abruptly cancelling the centre. According to the learned counsel, all these aspects

2 wp 1585.17 are not considered and only on the ground that strength of students has been reduced, the centre has been cancelled. Even the other colleges are agreeable for the centre at the petitioner college. All these aspects need to be considered. 2.

Miss Mahajan, the learned counsel for the respondent No. 2 states that, out of 149 students, 71 students are residents of Parbhani city and the centre is being alloted in Parbhani city. According to the learned counsel, the distance is 10 K.M., it would not be feasible to have the students of the petitioner college only for the centre.

We have considered the submissions canvassed by the learned counsel for respective parties.

As per the record of the Board, the show cause notice was issued to the petitioner, though the petitioner contends that the same is not received by the petitioner. However, we are not entering into said disputed facts. Show cause notice was issued as per the record of the respondent No. 2. Out of 149 students, 71 students are shown to be residents of Parbhani city itself, where the centre is allotted and remaining students are also from different places and not of the place where the petitioner college is situated. The other colleges which are attached earlier with the petitioner college have not made any grievance, they being

Considering the aforesaid conspectus of the matter, the grievance of the petitioner cannot be considered. The writ petition is disposed of. No costs.
