As per directions of this Court, present complaint of police atrocity was referred to learned Chief Judicial Magistrate for finding facts.

Learned Chief Judicial Magistrate has submitted a report in which he clearly found that the petitioner was illegally detained.

Instead of proceeding with the petition further, we deem it necessary to send the case to Police Complaint Authority which is constituted as per

crwp170.15 Section 22-P of the Maharashtra Police Act. We are sure that the petitioner would be heard and his complaint would be redressed.

The writ petition is disposed of accordingly.
