This Contempt Petition is filed for non-compliance of the order dated 21st January, 2019 passed in Writ Petition No. 11708 of 2018. The relevant part of which reads as under : "4.The Education Officer shall consider the say of the petitioner and respondents No. 4 & 5, and take decision with regard to the dispute about the seniority and thereafter decide the proposal seeking approval to the appointment of the Petitioner as Headmaster, afresh. The same shall be done within a period of two months from the date of appearance of the parties. Till the Education Officer takes the decision, the interim order dt. 17.12.2018, shall continue.

5. The writ petition is accordingly disposed of. No costs. In view of the disposal of writ petition, the pending civil application if any stands disposed of."

It is submitted by the learned Advocate for the Petitioner that belatedly his application came to be considered and the order is passed on 14.12.2023.

Learned AGP appearing for the answering Respondent draws our attention to the affidavit dated 21.02.2020 of the Respondent No. 3. The said order is subsequent to the said affidavit. It is submitted by the learned AGP that the earlier Education Officer is no more in service.

In view of the above, as the order is complied with, we see no point in keeping the Petition pending and hence, the Petition is disposed of.
