In spite of service, none appears for respondent No.2. Mr. Ishwar K. Wagh, learned Advocate is appointed to represent the respondent No.2.

Heard. Similarly placed co-accused have been granted relief by this Court vide order dated 10/1/2023. 3.

Learned A.P.P. and learned counsel appointed to represent respondent No.2 tried to make the distinction between the case of the present applicant and those who have been granted relief. We, however, not at one with their submissions. We find the

case of the applicant to be at par with those who have been granted relief. In view of the principle of parity, we allow the application in terms of prayer clause (B) to the extent of the present applicant. 4.

The applicant to deposit Rs.7000/- (Rupees seven thousand) with this Court within eight days from today, towards fees of Advocate appointed for respondent No.2. Once the amount is deposited, the same be paid to Mr. Ishwar K. Wagh, learned Advocate.

List the matter for compliance of this order on 24th July 2023.
